Terms of Use

The agreement between you and us when you sit for a portrait in Jane Austen Photo Studio.

Version 2026-08-21 · Published 30 September 2026

In shortJane Austen Photo Studio paints AI-generated portraits for fun. They are not photographs, may not resemble the person exactly, and should not be treated as factual.

These Terms of Use govern your use of the Jane Austen Photo Studio iPhone app, provided by Sing Me Happy Birthday Ltd. By using the app, and by accepting these terms when you sign in with Apple, you agree to them. Please read them with our Privacy Policy.

1. The service

You choose a character, submit a photo and ask us to paint an AI-generated Regency portrait. The app lets you view, save and share each finished portrait. AI generation is probabilistic: results vary, may contain errors and are not guaranteed to meet a particular expectation.

2. Age and eligibility

You must be at least 13 years old to use Jane Austen Photo Studio, and if you are under 18 you need the permission of a parent or guardian. Do not submit a photo of a child unless you are their parent or guardian and have the right to do so.

3. Your photo and your rights

You keep your rights in the photo you submit. You give us a limited permission to store, transmit and process it only as needed to provide, secure and operate the service, as described in the Privacy Policy.

You confirm that the photo is of you, or of another person who has agreed to it being submitted and transformed, and that you have the right to use every image you submit.

4. Acceptable use

You must not use Jane Austen Photo Studio to:

  • submit a photo of another person without their informed agreement;
  • create or share unlawful, abusive, deceptive, harassing or infringing content;
  • impersonate someone, pass off an AI portrait as a real photograph, or use a portrait as evidence;
  • probe, disrupt, reverse engineer or misuse the app or service; or
  • get around safety, account, payment or portrait limits.

Our AI providers may refuse images or requests for safety reasons.

5. Free portraits and portrait packs

Your first portrait is free, and two more are free when you sign in with Apple. They can be of any character marked free in the app. Further portraits come in packs sold through Apple’s App Store as one-off purchases, not subscriptions.

Portrait credits have no cash value, cannot be transferred and do not expire while the service and your account remain available. Prices and taxes are shown by Apple before you buy, and Apple processes the payment.

6. Refunds

Apple controls App Store refunds. We cannot approve or pay an App Store refund ourselves; request one through Apple’s refund process.

If you turn on “Help Apple review refund requests” in the app, you agree that when you ask Apple for a refund we may tell Apple whether the portraits you bought were delivered and what proportion of them you had already used. This setting is optional and off by default, and you can turn it off at any time in Profile. If Apple grants a refund, the related portrait credits are reversed, and your balance may become negative if they were already used.

7. AI processing and third parties

To paint your portrait we send your photo and the instructions for the character you chose to a third-party AI image generation provider. Details of storage, processing, retention and your choices are in our Privacy Policy.

8. Your portraits

You may save and share your portraits for personal, lawful purposes, and you are responsible for how you use and share them. We do not promise that a portrait will be unique; AI systems can produce similar results for different people.

9. An independent app

Jane Austen Photo Studio is an independent app inspired by Jane Austen’s novels, which are in the public domain. It is not affiliated with, endorsed by or connected to any publisher, film or television adaptation, studio or estate. Portraits of real historical people are imaginative portraits made for fun.

10. Availability and liability

We aim to keep the service available but do not promise uninterrupted or error-free access. We may change, suspend or discontinue characters or features where reasonably necessary.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud, or your mandatory consumer rights. Subject to that, we are not responsible for indirect or unforeseeable losses, or losses caused by misuse of the app, and our total liability connected with a paid purchase will not exceed the amount you paid for it.

11. Ending use and deleting your account

You may stop using the app at any time. You can delete individual portraits in the app, and delete your account in Profile › Delete Account, which permanently deletes your account, portraits and any unused credits. Deleting your account explains exactly what is deleted and what is kept. Signing out does not delete your account or the information held on our servers.

12. Governing law and changes

These terms are governed by the law of England and Wales. If you are a consumer, you keep any mandatory protections and any right to bring a claim where you live.

We may update these terms when the service or the law changes. Material changes will use a new terms version, and we may ask you to accept the updated terms before you continue.
